1. License Grant

 

ARLABS LLC (“Licensor”) grants you a non-exclusive, non-transferable, revocable license to use Speakify on any Apple‑branded device that you own or control, solely in accordance with this Agreement and any applicable usage guidelines. Speakify is licensed, not sold.

2. Eligibility

 

You represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this Agreement.

3. User Accounts and Responsibilities

 

Some features of Speakify require registration. In creating an account, you agree to:

• Provide accurate, current, and complete information.

• Maintain and promptly update your registration details.

• Keep your account credentials confidential and be solely responsible for all activities that occur under your account.

4. Permitted Use and Restrictions

 

You agree to use Speakify only for lawful purposes and in compliance with all applicable laws. Without limiting the foregoing, you shall not:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of Speakify.

• Modify, distribute, sublicense, or create derivative works based on Speakify without our express written consent.

• Use Speakify in any manner that could impair, disable, or overburden our services or interfere with any other party’s use of Speakify.

5. Intellectual Property

 

All content, features, and functionality in Speakify—including, without limitation, text, graphics, logos, icons, and software—are the exclusive property of ARLABS LLC and are protected by intellectual property laws. You agree not to remove or alter any proprietary notices contained in Speakify.

6. Data Collection and Privacy

 

By using Speakify, you consent to ARLABS LLC’s collection and use of technical data and related information (in a form that does not personally identify you) to help improve the application, provide product support, and offer updates. Please review our Privacy Policy for further details.

7. External Services

 

Speakify may include links or provide access to third‑party services or websites (“External Services”). You acknowledge and agree that:

• Your use of External Services is solely at your own risk.

• ARLABS LLC is not responsible for the content or accuracy of any third‑party services.

• Any use of External Services is subject to the terms and conditions of the respective providers.

8. Termination

 

This Agreement is effective until terminated. ARLABS LLC may suspend or terminate your access to Speakify immediately and without notice if:

• You breach any term of this Agreement.

• It is necessary to protect the rights, property, or safety of ARLABS LLC or its users.

9. Disclaimer of Warranties

 

SPEAKIFY IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING (BUT NOT LIMITED TO) ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON‑INFRINGEMENT. ARLABS LLC DOES NOT WARRANT THAT SPEAKIFY WILL BE UNINTERRUPTED, ERROR‑FREE, OR SECURE.

10. Limitation of Liability

 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARLABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE SPEAKIFY. IN NO EVENT SHALL ARLABS LLC’S AGGREGATE LIABILITY EXCEED FIFTY DOLLARS ($50.00).

11. Export Restrictions

 

You agree not to export, re‑export, or transfer Speakify in violation of any applicable export laws or regulations. By using Speakify, you represent that you are not located in any country subject to U.S. export restrictions.

12. Governing Law and Dispute Resolution

 

This Agreement shall be governed by and construed in accordance with the laws of the State of California, excluding its conflict of law principles. You agree that any disputes arising under or related to this Agreement shall be resolved exclusively in the state or federal courts located in Santa Clara County, California.

13. Changes to the Agreement

 

ARLABS LLC may modify this Agreement from time to time. Any changes will be posted on this page with an updated effective date. Your continued use of Speakify after the modifications have been posted constitutes your acceptance of the revised terms.
